Certificate of origin and tariff preferences: how origin affects customs payments

November 3, 2026 · Caucasus Customs and Logistics

A contract pins down price and shipping; origin is left until later. At customs, under one code, the payment depends on where the goods were made.

Origin is not the country of shipment

Under the Customs Code, origin is where the goods were wholly obtained or sufficiently processed — not the seller's address.

  • non-preferential origin — for applying the tariff and trade measures
  • preferential origin — only when a preference is claimed, under the agreement

Not every import requires it — the Code lets customs ask. Obtaining it is part of our certificates and permits service.

How is origin determined?

The first criterion is goods wholly obtained: minerals, plants and animals of one country. Where several take part, origin follows the last substantial transformation, measured three ways:

  1. a change of tariff heading between the foreign material and the finished good
  2. a threshold on the value share of non-originating materials (ad valorem)
  3. the carrying out of a specific manufacturing or processing operation

Labelling and simple assembly confer no origin; thresholds depend on the agreement.

Who issues the certificate?

On import the certificate comes from the exporting country's competent authority; on export from Azerbaijan, from the authority designated by law after an origin examination.

  • CT-1 — for exports to CIS countries
  • general form — for countries with no preferential agreement
  • Form A — a separate category, its status checked each time
  • bilateral agreements (Türkiye, Pakistan) — proof by their own rules, form per shipment

The exporter prepares these; the import package falls under import and export documents.

A certificate alone grants no preference

The CIS rules require several conditions at once: direct transport, origin and trade country coinciding, and the agreement's proof. Other agreements differ:

  • under cumulation, some foreign materials may count as originating
  • goods passing through a third country stay under customs control

For the importer this is not just paperwork: without proven preferential origin the duty stands in full.

When the document is questioned

Where doubt arises, customs may query the issuing body; until confirmation the declared country is not the origin. The goods are usually released on the terms the law sets, such as security for the duty, with the difference later collected or refunded.

We check which agreement applies, prepare the certificate and calculation papers, and align them with the customs declaration. Send the invoice, contract and product description.
